1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the Play Universe website and online store, accessible at www.playuniverse.co.za (“the Site”), and any purchase of products made through the Site.

By accessing the Site, creating an account, and/or purchasing products from Play Universe, you agree to be legally bound by these Terms, together with our Privacy Policy, Returns & Refund Policy, Delivery Policy, and the Happy Child Smile Guarantee, all of which form part of this Agreement.

If you do not agree to these Terms, you must not use this Site or purchase any products from us.

2. Eligibility and User Representations

2.1 By using this Site, you confirm and warrant that:

“Claim Amount” amount paid by the customer for the items or goods purchased on the site.

• “You” / “Your” refers to the Buyer, Parent, or Consumer using the Site.

6. Pricing and Availability

6.1 All prices displayed on the Site are in South African Rand (ZAR) and include VAT where applicable.

6.4 In the event of an obvious pricing error, we reserve the right to cancel the order and issue a full refund.

7.3 If an order is cancelled after payment, a full refund will be processed using the original payment method.

8.2 Delivery times provided are estimates only and are not guaranteed.

8.3 Risk of loss remains with Play Universe until the delivery has been accepted.

8.4 Play Universe shall not be liable for:

8.4.1 Courier delays;

8.4.2 Incorrect or incomplete delivery addresses supplied by the Buyer;

8.4.3 Failed delivery attempts due to customer unavailability.

9. Happy Child Smile Guarantee

Play Universe offers the Happy Child Smile Guarantee, which provides post-purchase support for 14 days from the date of delivery.

9.1 Subject to the conditions set out in our Refund Policy:

9.1.1 If a child is not satisfied with a purchased Item, the Buyer may request a refund, exchange, or store credit.

9.1.2 The Guarantee applies only to products purchased directly from Play Universe.

9.1.3 Proof of purchase (receipt or invoice) is required.

9.1.4 Items must be unused, in their original package received, and returned in their original condition.

10. Use of the Site

10.1 When using this Site, you agree not to:

10.2 Copy, store, modify, distribute, or interfere with any software, data, or content unlawfully;

10.3 Damage, impair, or interfere with the Site’s systems or security;

10.4 Introduce viruses, malware, or harmful code;

10.5 Engage in conduct that is unlawful, fraudulent, or infringes the rights of others.

11. Disclaimer and Limitation of Liability

11.1 While we strive to ensure product descriptions are accurate, minor variations may occur.

11.2 Accurate product specifications, intended use, and safety details can only be verified by the product manufacturer.

11.3 We strive to provide accurate product descriptions, age recommendations, and images. However: Minor variations in colour, packaging, or design may occur. Product images are provided for illustrative purposes.

The purpose of the product images is to serve as a visual guide to assist you in making an informed purchasing decision.

11.4 Play Universe does not manufacture the products sold and therefore product warranties, where applicable, are provided by the manufacturer and are subject to their terms.

11.5 We encourage parents and caregivers to review age recommendations and supervise children during play.

11.6 Play Universe shall not be liable for any injury, illness, loss, or death resulting from the use or misuse of products purchased from the Store.

11.7 Nothing in these Terms excludes or limits any rights that consumers may have under the Consumer Protection Act.

11.8 Buyers are advised to:

11.8.1 Supervise children during product use or play;

11.8.2 Review age suitability guidelines,

11.8.3 Follow manufacturer instructions carefully.

11.8.4 Avoid products that may pose choking or safety hazards;

11.8.5 Discontinue use if irritation or harm occurs;

11.8.6 Clean and disinfect products before first use.

11.8.7 To the fullest extent permitted by South African law, Play Universe’s liability is limited to the Claim Amount paid for the Item.

12. Electronic Communications and Records

In accordance with the Electronic Communications and Transactions Act (ECTA), by using our website or communicating with us electronically (including via email, website forms, or WhatsApp where applicable), you agree that:

12.1 All agreements, notices, disclosures, and communications sent electronically satisfy any legal requirement that such communications be in writing.

12.2 Electronic records generated by Play Universe shall be admissible and valid as evidence in any legal proceedings.

12.3 A data message (including order confirmations and invoices) will be regarded as received once it enters your designated email system.

We retain electronic records of transactions in line with applicable South African law.

For your peace of mind, we recommend keeping copies of your order confirmations and invoices.

13. Intellectual Property

All content on the Play Universe website, including:

• Logos

• Branding

• Product descriptions

• Graphics

• Images

• Website layout and design

• Text and written content

remains the property of Play Universe or its content suppliers and is protected under applicable intellectual property laws.
